Although the state of Colorado has made the recreational use of marijuana legal, there still seems to be some confusion as to what the limits are. In order to more fully understand the limits of the law in regards to possession, let’s take a look at the special classes of drug felonies.
DF1: This is the most serious level of drug felony. This would be a case where a bulk supply of a Schedule I or Schedule II substance was being distributed. The actual amount varies from substance to substance. For marijuana, a person may be charged with a DF1 drug charge for distributing a quantity of 2.5 pounds or greater, and the mandatory prison term is 8-32 years.
DF2 – DF3: These involve the distribution of smaller quantities of substances that you can be charged with a DF1 felony charge. Prison terms are also mandatory with these charges.
DF4: This is the lowest level drug felony charge. Attempting to ebb the incarceration rate for low-level drug felonies, the sentencing court has to ensure that treatment and rehabilitation efforts have been made prior to prison sentencing. This charge is put into effect for cases of possession of more than 12 ounces of marijuana. For other cases involving the distribution of substances, the quantities are four grams or less.
